Building Code Appeals
Any decisions made by the Building Official while enforcing the Building Code, Plumbing Code, Mechanical Code, and Electrical Code may be appealed to the Board of Zoning Appeals by any person affected by the decision. The appeals board may hear an appeal for interpretation made by the building official or inspector.
Procedure: Fill out application form and submit it to the Building and Codes Department, along with the application fee. Click Here for an application form or obtain one from the Building and Codes Department, (913) 667-1710.
Fee: For each item appealed, there is a $100.00 non-refundable filing fee, which is due at the time the application is submitted.
Process: A meeting date is scheduled, and an agenda and all supporting documents will be sent to the Board of Zoning Appeals and applicant prior to the meeting date. At the hearing, any party may appear in person, by agent or by attorney. All testimony, objections and rulings will be recorded in the form of minutes of the meeting.
